Changes to these terms and our site

We may update these terms at any time. Check them each time you use our site. The current version always applies.

We may update, change, suspend or withdraw our site (or any part of it) at any time for business or operational reasons. We will try to give you reasonable notice where possible. Our site is made available free of charge. We do not guarantee it will always be available or uninterrupted.

Your account

If you create an account, you must keep your login details confidential. Do not share them with anyone. If you think someone else has accessed your account, tell us immediately at hello@sewdirect.com.

We may disable your account if you breach these terms.

You are responsible for making sure anyone who accesses our site through your internet connection knows about and complies with these terms.

Intellectual property

We own or license all intellectual property rights in our site and the content published on it, including product images, descriptions and designs. All rights are reserved.

You may print one copy and download extracts of any page for your personal use. You may draw the attention of others to content on our site.

You must not:

  • modify any materials you have printed or downloaded
  • use any images, video, audio or graphics separately from the accompanying text
  • use any content from our site for commercial purposes without our written permission

If you breach these rules, your right to use our site ends immediately. You must then return or destroy any copies you have made.

No data mining, scraping or AI training

You must not conduct, facilitate or permit any text or data mining, web scraping or similar automated data extraction in relation to our site. This includes using any bot, spider, scraper or other automated tool to access, copy or republish any part of our site or its data.

You must not use our site, or any data published on or accessible via our site, to develop, train, fine-tune or validate any AI system or model.

This is an express reservation of our rights, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).

This clause does not apply to the extent we cannot exclude such activity by contract under applicable law.

Content you upload and user-generated content

Our site allows you to upload content, including reviews, photos and PDF files for print on demand products. You may also send us content by email, social media or other channels.

All of the above is user-generated content. When you submit content to us by any means, you must comply with our acceptable use standards below. You warrant that your content complies with those standards. You are liable to us and indemnify us for any breach of that warranty.

If you upload a file for printing, you confirm that you have the right to reproduce that content and that it does not infringe any third party’s rights. We may refuse or cancel an order if an uploaded file is unlawful, offensive, infringes someone else’s rights, is corrupted or is not suitable for production. Further terms relating to print on demand products are set out in our Terms and Conditions of Sale.

We treat user-generated content as non-confidential and non-proprietary. You keep ownership of your content. By submitting it to us (whether on our site, by email, on social media or by any other means), you grant us a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, display, adapt and promote that content in any media, including for marketing purposes. For content uploaded to our site, this licence expires when you delete it. For content sent to us by other means, this licence is perpetual.

We may remove any content on our site that, in our opinion, breaches these terms. We may also disclose your identity to anyone who claims your content infringes their intellectual property rights or right to privacy.

Content uploaded by users is not verified or approved by us. The views expressed by other users do not represent our views or values.

Acceptable use

You must not use our site:

  • in any way that breaches any law or regulation
  • for any unlawful or fraudulent purpose
  • to harm or attempt to harm minors
  • to bully, insult, intimidate or humiliate any person
  • to send or upload material that does not comply with these standards
  • to transmit spam or unsolicited promotional material
  • to transmit viruses, trojans, worms or other harmful code

Content you upload must be accurate where it states facts, and must only contain opinions you hold. It must not be defamatory, obscene, offensive, hateful or inflammatory. It must not infringe anyone’s intellectual property rights or breach any legal duty owed to a third party. It must not promote illegal activity, impersonate any person, or give the impression it comes from us.

You must not upload, share or generate any illegal content, including content relating to terrorism, child sexual exploitation, hate offences, harassment or fraud. You must not upload pornographic content, or content that encourages suicide, self-harm or eating disorders.

Linking

You must not link to our site in a way that suggests association, approval or endorsement where none exists. We may withdraw linking permission at any time. Any site linking to ours must comply with our acceptable use standards.

Third-party links

Our site may contain links to third-party websites. We have no control over those sites and accept no responsibility for their content. A link does not imply our endorsement.

Viruses and security

We take reasonable steps to keep our site secure and free from viruses, but we do not guarantee this.

You are responsible for configuring your own IT, programs and platform to access our site. Use your own virus protection software.

You must not misuse our site by introducing viruses, trojans, worms, logic bombs or other harmful material. You must not attempt to gain unauthorised access to our site, its server or any connected server, computer or database. You must not attack our site via a denial-of-service attack.

Breaching this provision is a criminal offence under the Computer Misuse Act 1990. We will report any breach to the relevant law enforcement authorities and disclose your identity. Your right to use our site will end immediately.

How-to content and embedded video

Our site includes how-to guides and tutorials that may contain video content embedded from third-party platforms. We do not control those platforms and accept no responsibility for their content, availability or privacy practices. Your use of embedded video is subject to the third party’s own terms and policies.

The how-to content on our site is for general guidance only. It is not professional advice. We are not liable for any loss or damage arising from your reliance on it.

Our site includes general information, guides and how-to content. This is provided for general information only. It is not advice you should rely on. We make reasonable efforts to keep it accurate and up to date, but we give no guarantees, whether express or implied, that it is accurate, complete or current. This disclaimer does not apply to our product descriptions or to the terms of any contract between us.

Product images are for illustration purposes only. True colours may not exactly match what you see on your device, and packaging may vary. Where we show images of finished items made from our products, these are for inspiration only and are not included in your purchase. Each product is sold based on its written product description.

Our liability

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, and for fraud or fraudulent misrepresentation.

If you are a business user: We exclude all implied conditions, warranties, representations or other terms that may apply to our site or its content. We will not be liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising from your use of or inability to use our site, or your reliance on any content on it. In particular, we will not be liable for loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation, or any indirect or consequential loss.

If you are a consumer: We only provide our site for domestic and private use. You agree not to use it for commercial or business purposes. We have no liability for any loss of profit, loss of business, business interruption or loss of business opportunity. If defective digital content we have supplied damages your device or digital content, and this is caused by our failure to use reasonable care and skill, we will repair the damage or pay compensation. We will not be liable for damage you could have avoided by following our advice to apply a free update, or damage caused by your failure to follow installation instructions or meet minimum system requirements.

Transfer

We may transfer our rights and obligations under these terms to another organisation. We will tell you in writing if this happens. The transfer will not affect your rights.

Law and jurisdiction
